CESOP: exchange of cross-border payments and receipts to the tax authorities

Do you have a payment account or current account with us? If you do, as of 2024, we may be required to report cross-border payments and receipts on this account to the tax authorities. This stems from obligations imposed on payment service providers in European Union Member States as of 2024.

Why does Rabobank exchange data with the tax authorities?

Cross-border online sales of goods and services pose a challenge to government efforts to combat VAT fraud. This is because the seller is often located in a different European Union Member State or outside the EU. On 18 February 2020, the Council of the European Union adopted Council Directive (EU) 2020/284 on the introduction of certain rules for payment service providers. It aims to improve efforts to combat VAT fraud. This directive is also referred to as the CESOP Directive. It entered into force in the Netherlands on 1 January 2024. Under these rules, a payment service provider must report the information it has on the beneficiary of a cross-border payment to the tax authorities. This obligation only applies from 26 cross-border payments per quarter to the same beneficiary. The European tax authorities must collect and report these data to the EU CESOP database. Alerts issued by this database help tax authorities to combat VAT fraud.

Can my data be exchanged if I am not a merchant?

The European Directive does not oblige Rabobank to provide data about the person who makes the payment. If you make a cross-border payment, the payment may have to be reported, but Rabobank does not provide any data about the person who made the payment. However, payment service providers are required to provide data about the person receiving the cross-border payment. This applies unless fewer than 26 cross-border payments per quarter are made to the same beneficiary. Once the number of payments reaches or exceeds 26, all payments must be reported. This also applies if the payments are not related to online sales of goods and services.

What data are exchanged?

As stated above, Rabobank does not report any data about the person who made the payment. However, Rabobank is legally obliged to report data to the tax authorities about any person receiving 26 or more cross-border payments. This includes the person’s name or company name, VAT identification number or other national tax number, the IBAN, and the address.
